Terms of Service
These terms are the agreement between you and Howdy LLC, which operates Dearlo. By creating an account or using Dearlo, you agree to them. Please also read our Privacy Policy, which explains how we handle your information.
1. Who can use Dearlo
You must be at least 13 years old to use Dearlo. If you’re under 18, you need a parent or guardian’s permission, and a parent or guardian must make any purchases.
2. Your account
- Give us a real email address you control, and keep your password safe.
- You’re responsible for activity on your account.
- Each person may use one free-search allowance. Creating extra accounts to get more free searches isn’t allowed.
3. Your content
You own what you add — names, photos, notes, and Gift Quiz answers. You give us permission to store and process it only as needed to run Dearlo for you, including sending relevant details — and any photos you add — to our AI provider to describe their style and generate suggestions, as described in our Privacy Policy.
Much of what you add is about other people. By adding it, you confirm you’re allowed to share it, that you won’t add sensitive information (like health, religious, or financial details), and that you have the right to upload any photos you add.
Children: if you add information or photos about anyone under 18, you confirm that you are their parent or legal guardian, or that you have their parent or guardian’s permission to do so.
4. AI gift suggestions
- Suggestions are generated automatically by artificial intelligence. They can be inaccurate, out of stock, priced differently than estimated, or not a good fit. Please check details before buying.
- Product links go to third-party stores. We don’t sell, ship, or guarantee any product, and any purchase is between you and that store.
- Dearlo is not affiliated with, endorsed by, or sponsored by the brands or stores mentioned in suggestions or on our website. All trademarks belong to their owners.
5. Free searches, Dearlo Plus, and packs
- New accounts get 1 free gift search. The allowance is tied to your email address, not your account.
- Dearlo Plus is a subscription billed monthly or yearly, at the price shown before you subscribe. It includes 20 gift searches per calendar month; unused monthly searches don’t roll over.
- Plus renews automatically at the end of each billing period, and your payment method is charged, until you cancel. You can cancel anytime from your Account page; you’ll keep Plus until the end of the period you’ve paid for, and you won’t be charged again. We’ll give you notice before any price change takes effect for your subscription.
- You can also buy one-time packs of searches. Pack searches don’t expire while your account is open. Prices are shown before you buy, and we may change prices for future purchases.
- If a search fails because of a problem on our end, it doesn’t count against your searches.
- Prices may not include sales tax. Where tax applies, it’s shown at checkout before you pay.
- Promo codes have no cash value, can’t be combined unless we say so, and may expire.
- We may add, change, or remove Dearlo Plus features over time. If a change meaningfully reduces what you get, we’ll tell you before your next renewal so you can cancel.
- Searches have no cash value and can’t be transferred or exchanged. Unused searches are lost if you delete your account.
- Payments on our website are handled by our payment processor. Purchases in our iPhone app are handled by Apple and are also subject to Apple’s terms.
6. All sales are final
Search packs and subscription payments are non-refundable, including for partial billing periods, except where a refund is required by law. Cancelling stops future charges. If something goes wrong with a purchase — for example you were charged but didn’t receive your searches — email us at matthuntbiz@gmail.com and we’ll make it right. Refunds for purchases made through Apple are handled by Apple.
7. Reminders and calendar sync
Reminder emails and calendar sync are conveniences, not a guarantee. Emails can be delayed or filtered as spam, and calendar apps update on their own schedules, so please don’t rely on Dearlo as your only reminder for important dates. Your private calendar link shows the names and dates you’ve saved to anyone who has it, so keep it private; you can reset it anytime.
8. Acceptable use
Please don’t:
- Use Dearlo for anything illegal, harmful, or harassing.
- Try to get around the free-search limit, access other people’s accounts, or interfere with the service.
- Use bots or scripts to access Dearlo, scrape it, or copy or resell our suggestions or software.
9. Ending your account
You can delete your account at any time from your Account page; doing so cancels any active subscription. We may suspend or close accounts that break these terms, and we may change or discontinue features of the service. If we shut down Dearlo entirely, we’ll give reasonable notice.
10. Disclaimers
Dearlo is provided “as is” and “as available.” To the extent allowed by law, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and we don’t promise the service will be uninterrupted or error-free.
11. Limitation of liability
To the extent allowed by law, Howdy LLC won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim related to Dearlo is limited to the greater of the amount you paid us in the 12 months before the claim, or $50. Some places don’t allow these limits, so they may not all apply to you.
12. Indemnity
If you break these terms or misuse information about other people, and that leads to a claim against us, you agree to cover the reasonable costs of that claim, to the extent allowed by law.
13. Resolving problems
If you have a problem with Dearlo, please email us first at matthuntbiz@gmail.com. We’ll try in good faith to sort it out within 30 days before either of us takes it further. This doesn’t affect any right you have to dispute a charge with your bank.
14. Governing law
These terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Wisconsin, unless the law where you live gives you the right to bring it elsewhere.
15. Changes to these terms
We may update these terms. We’ll change the date at the top of this page, and for significant changes we’ll notify you by email or in the app before they take effect. Continuing to use Dearlo after that means you accept the updated terms.
